Supporting a client through a GBP 7 million loss
A fire caused extensive damage to one of our policyholder’s waste and recycling facilities. Insurers subsequently sought to deny the claim, citing an alleged breach of warranty conditions.
Our team engaged immediately with insurers, adjusters and legal advisers, helping establish a clear understanding of the circumstances while securing substantial interim payments to support the client’s recovery. Reflecting on the experience, one of our retail broking partners commented,

Challenging an insurer’s position
In a case involving damaged plant and machinery, insurers relied upon a ‘deliberate acts’ exclusion to deny cover and subsequently refused to engage further.
Our specialists escalated the matter, challenged the interpretation being relied upon and highlighted inconsistencies between the insurer’s position and the policy wording itself. As discussions progressed, the insurer withdrew its position and agreed to revisit the claim. Our retail broker partner later commented,

Turning a denial into a successful recovery
Public liability insurers initially refused to reimburse our policyholder’s legal expenses after relying upon an extremely narrow interpretation of the policy wording. Our team prepared a detailed response, challenged the insurers’ position and drew upon established market relationships to reopen discussions.
Insurers ultimately withdrew their denial, paid the claim and agreed to an additional goodwill contribution that formed part of the following year’s renewal negotiations.
Recovering GBP 265,000 after a year of delay
Following the appointment of Consilium as broker, we assumed responsibility for a claim that had remained unresolved by the predecessor broker for more than a year.
Insurers had refused to reimburse approximately GBP 265,000 in legal and investigation costs. By revisiting the relevant policy wording and applying a detailed legal analysis, we successfully negotiated the recovery of approximately 95% of the amount in dispute.
Securing a GBP 1.9 million recovery
One of our offshore corporate services clients incurred substantial remediation costs following a regulatory review.
Insurers initially rejected the claim, placing considerable pressure on the business and its cash flow position. Fortunately, bespoke policy language developed with the support of our in-house legal specialists provided a solid foundation for negotiations.
After extensive discussions, insurers agreed to reimburse the costs in full. Significantly, the accounting firm involved in the matter described the outcome as the first of its kind they had encountered.
